    Senate parliamentarian rules AGAINST including minimum wage hike in Covid relief bill

    Elizabeth MacDonough is the Senate parliamentarian, a nonpartisan advisor on how the congressional chamber's rules and protocols are applied.

    MacDonough's ruling could possibly be overruled by Vice President Kamala Harris, but it's unclear if Harris will do so. If she doesn't, Democrats will have to introduce a minimum wage hike as its own standalone Senate bill. Passing the bill would likely require 60 votes, including all 50 members of the chamber's Democratic caucus and 10 Republican members.

    Thank you for making a thread with quality content and correct facts. You even stated in the op it was the parliamentarian.

    I really dislike OBRA as a means of passing important legislation. I wonder what the "rule" was, I read of the articles and didn't see the specific rule.

    The Democrats shouldn't overrule the parliamentarian.

    However, it remains to be seen if the Senate parliamentarian would decide that the increase jibes with the Byrd Rule, which requires that a piece of legislation has an effect on the federal budget and that it is not “merely incidental” to that effect in order to qualify to pass through reconciliation.

    As president of the Senate, Vice President Harris would be able to overturn the parliamentarian if she decides the minimum wage provision must be scrapped. However, Biden, who served in the Senate for 36 years, is a staunch institutionalists who has expressed hesitance to changing the upper chamber’s rules.

    The minimum wage provision has torn open divisions among centrist and progressive lawmakers.

    Sen. Bernie Sanders (I-Vt.), the chair of the Senate Budget Committee, has said he’s confident the minimum wage hike would be included and in the bill pressed senators to come around to the measure. But centrists like Sens. Joe Manchin (D-W.Va.) and Kyrsten Sinema (D-Ariz.) have balked at the increase, raising the prospect that the minimum wage provision could be killed in the 50-50 Senate even if the parliamentarian greenlights it.

    I have no idea how the student loan relief would pass Byrd either.

    The thing is, the D need their base to show up in the midterms, so by holding things back and blaming the R for it...it turns out votes and hopefully for them, expands their power.

    More likely their voters blame them, especially after they've been told "give us power and we'll give you everything you want" and stay home in 2022 cause why bother.

    Edit: if it happened under rockstar Obama it will happen under boring Biden and an unenthused base.
